Enforcement & By-Law Services – Damage Caused to Street, Boulevard or Road Allowance – Order to Comply
It is prohibited to damage or alter any city owned property including:
- Street/road
- Boulevard
- Curb
- Road allowance
Examples of damage:
- Something left on the road, e.g., a disposal bin dropped onto the road
- Oil or other substance resulting from a previous leak
- The surface of the boulevard or road allowance has been altered, e.g., paved so that it can be used to park cars
Upon investigation, if a By-Law Enforcement Officer finds a violation:
- Officer writes an Order To Comply (OTC) and hand delivers it to the resident or tapes it to the door. In the case of a tenanted property the OTC may also be sent via registered mail to the property owner.
- As proof, photographs are taken of the street, boulevard, sidewalk or road allowance to document the damage.
- Officer re-inspects after the OTC has expired
- If no attempt has been made to comply to the Order, the Officer takes more pictures, updates the files and the job is referred to the responsible department. Enforcement action including an AMPS penalty Notice may also be issued to the violator or registered property owner.
