Enforcement and By-Law Services - Pool Gate Open or Fence Down

The City requires you to enclose a pool, spa, hot tub, or any artificial body of water outdoors on your property, in which you can swim or in which the water can be deeper than 60 centimetres (24 inches).

You must get a permit to build a fence to enclose the pool.

The City of Brampton will investigate if:

  • The open gate cannot be secured by the owner (not home) or the complainant (you).
  • There is no fence around the pool or yard, or fence is broken down so it does not secure the pool area.
  • The pool under construction poses a safety hazard e.g. deep hole in ground that is not secured.
