Enforcement and By-Law Services - Overgrowth and Prohibited Plants on Private Property

The Ground Cover Maintenance & Prohibited Plants By-law, (originally the Grass and Weed Cutting By-law) allows Natural Gardens but requires that all property owners maintain their gardens and groundcover to a maximum height requirement and free of Prohibited Plants. The​ ​Encroachment By-law expands on past public lands by-laws to clarify types of encroachments and specify allowed encroachments, like Boulevard Gardens.

Residential, commercial and industrial property owners must keep their lawns/property from becoming overgrown with Prohibited Plants and must keep their lawns no higher than twenty centimetres (20 cm) or eight inches (8”) in height.

Possible Violations:

  • Area not maintained or intentionally cultivated
  • Area encroaching on the sidewalk/roadway
  • Area obstructing driver/pedestrian sightlines
  • Area contains Prohibited Plants
  • Area has grass over 20 cm

Owners of property in violation of the By-Law will receive:

  • A 3 day Order to Comply.
  • If the specifications of the Order are not met,
    • The City contractor will deal with the contravention at the expense of the owner.

The City will recover the expense incurred by adding the expense to their municipal tax bill.
