Trees that encroach on or overhang property lines cannot be cut or trimmed without written permission from the owner of the property on which the tree resides.
The City of Brampton recommends contacting the owner of the tree prior to any work being completed. If private tree work is required, residents should hire a qualified arborist.
City of Brampton does not have jurisdiction in:
- A neighbor dispute about a tree hanging over the property line.
Residents are responsible for:
- Asking the neighbour in writing for permission to trim the tree and ask for a response in writing that includes an absolution of liability for damage to the tree
- If the neighbour does not reply, or does not trim the tree him/herself, the caller can take the matter to civil court
Important:
- Trimming someone else’s tree without permission could result in a civil court case.
- If the tree dies because of trimming you could be liable for cost to replace the tree
